Proposition 90
Alright, I need to let you know about this one. On the commercials the people arguing against Prop 90 say that this will cost property owners more money. However, that is quite the contrary. Here is what Prop 90 essentially does:
Basically, this prop reiterates the constitutional requirement for just compensation on the taking of property for public uses. But, it goes one step further in defining just compensation as the "highest price the property would bring an in open market". Typically just compensation means the fair price, not necessarily the highest price.
Then it goes another step by stating that plaintiffs will not have to pay attorney's fees and costs to the government in eminent domain actions.
So, the government will have to eat the cost and pay lots of money to obtain old property, condemned property, aesthetically displeasing property, nonconforming uses, etc, for public use.
The prop will not increase costs to property owners, but to the government, which derives its funds from public taxes.
EVERYONE WILL BE HIT HARD BY THIS PROP, EXCEPT THE PRIVATE PROPERTY OWNERS WHOSE LANDS ARE TAKEN.
This is not a fair proposition!!
